    Surfing Child Porn May Land You in Jail

After the amended Information Technology Act made it illegal to publish and transmit obscene material or any sexually explicit act/content last month, a newly passed IT Bill is set to punish offenses revolving around child pornography.



So what exactly has been touted as an offense? The new bill is set to make it illegal to not only create and transmit child pornography in any electronic form, but even to browse it, as reported by The Times of India. Publishing and transmitting material depicting children in a "obscene or indecent or sexually explicit manner" can put you behind bars for a long duration - five years, not to mention the hefty Rs. 10 lakh fine it attracts.


Section 67 of the existing act will now be amended. Section 67B proposes particularly to punish acts of publishing and transmitting any electronic sexually explicit act/content that depicts children as opposed to Section 67, which does not specifically mention children anywhere. Now, it will also be an offence to "cultivate, entice or induce children to have an online relationship with other children for a sexual act," the report added.

And does applying ban of child pornography resolves all the issues of such repugnant vice of viewer. What about other demented porns like bestiality , necrophilia , bdsm and other hardcore stuff ? People still have access to such content which I think is worse than child pornography. There is no object oriented approach towards tackling such issues and what about the point Sam made about computers accessing such content due to installed malware and other bot programs without the consent of the user.

Crafting a law that mostly has it founding roots based on the fear propaganda and impractical assumptions not to mention backed by bureaucratic influence, this step to stop child pornography is very limited and just like other sections of IT Acts - difficult to implement. While we know its practically impossible for the law to catch big fish residing outside the country , applying censorship to such materials for the viewers is certainly less feasible because if a person is perverted it is not because of accessing excess amount of online porn but sexual deprivation caused by the orthodox and hypocritical Indian society that causes such things.Banning ips leads no where we have seen it in the past for countless times while we can certainly be sure that there is more than one way to access anything on the Internet.

I solely agree with what Nitin has to say. To keep the focus on the real issue and look into the bigger picture. Penalizing people for watching child porn can only be a partial remedy to the problem as it is widely known creators of such genre of online porn usually operates from outside India and for most part some wicked Russian and Vietnamese network blocks whom our law can only dream of apprehending and executing justice.

OK guys, here is a thought, there are couple of people praising the bill because this looks to be a good start, but IMagine only 1% optimistically use the anti-virus softwares and less than that know about it..Secondly you machine can be taken control of malware, spyware and stuff like when u try to download games and some softwares for your personal use.Now If some kid or some house wife or some granny/granpa try to access internet for there personal use and accidentaly gets the malware isntalled many times this happens, and his search is controlled by some crap search which redirects to some junk links inclding porns , should the housewife, uncle and grannies be punished.Do they know what is happening aren't they innocent,think about it, its a good law but wrongly implemented

Ankur and Sandeep, because of the shortsightedness of guys like you, India has never progressed. The discussion here is about how to prevent a bad thing that happens in society. We are discussing about way to eradicate the child pornography, if there is someone who had seen or addicted to it, giving you the right tips of how to tackle it, let him speak, and analyze it how it can be helpful. Instead of making personal attacks like the non-sense politicians in our parliament do. Be mature, and try to see beyond your egoistic and short tempered brain. Your non-sense of this sending IP to police etc, has now scared a person from telling which could had been helpful. Do you really think police will have time to go after your complain? even if you do so. Shortsighted people are those who can not focus on the subject on the table to reach a meaningful conclusion, instead they just make the system chaotic with personal attacks. Grow up guys there is a problem here think about solving it, and let others speak what their opinion is, instead of self deriving conclusions followed by personal attacks.

Sentence too less. Make it at par with Rape offence. Also include companies who host these website and cooperate with international agencies and Internet companies to ban IP addresses of the hosting company and the viewing party.

Child pornography is no doubt a matter of condemnation. But it is too much to penalized the viewers who are themselves victim in as much as the sites have perverted their mind and they have been addicted. Those who are making profit out of pornography by filming and displaying the porn images need to be punished instead.

Your breed of people are responsible for child pornography and child abuse. 5 yr jail + 10 L fine is not at all too much for anyone who purposefully browse and transmit child porno. You mean you are perverted and addicted by child porno?? Editors, please note his IP and forward to police. I am sure he would have a plenty of obscene materials on his HD. If there are no people seeking prostitute, there would be no men making profit out of that trade. The moral policing begins with your own mindset.

If we analyse the information technology amendment bill, 2008 one thigh is for sure. We Indians are going to be in big mess. Whether it is the power of electronic interception and surveillance or child pornography/pornography or cyber terrorism or any other stupid and thoughtless provision, the end result would remain the same, big mess and trouble. If we analyse the bill in detail it is clear that the hurry and unthoughtfulness of the legislatures has distorted the IT Act, 2000 further to a stage beyond repair. If still they have some common sense remained they must scrap the bill and come up with some good legislative draft.
