Four Google officials await judgment. The charges? Defamation and failure to exercise control over personal data.
Here's the why -- A video filmed using a mobile was posted on Google's site. The video showed four youths harassing a boy with Down Syndrome; hitting him on head with a tissue pack.
Francesco Cajani, the Italian prosecutor in this case, has ordered four Google defendants to appear in court on February 3rd against a suit filed by Vividown, an Italian Down syndrome advocacy group and the boy's father.
The video was posted in 2006 on Google Video, back when Google Video was still around... Though Google immediately pulled down the video after receiving a complain from a department of Italian Interior Ministry, that investigates cyber-crimes.
Macro Pancini, Google's European public policy council, said that prosecutors appear concerned that the video brought the boy's disability into picture, which runs foul of data protection rules. As of now, Google isn't aware of the specifics of the charges, however the official company statement expressed disappointment that information was leaked to the media before it reached Google.
Pancini further defended Google and claimed that as per European e-commerce directives, the service providers are exempted from prescreening content before it goes public. As per Pancini, the video was technically uploaded on Google's US server and not in Italy; though he felt that the video was terrible.
