Apple Sued over iPhone Price Cut

Techtree News Staff, Oct 03, 2007 1734 hrs IST

Why? Because Dongmei Li of New York lost out on the $200 price cut announced by Apple just 68 days after the July debut of its iPhone.

An 'early bird' buyer who self-admittedly 'waited for hours' in order to buy a 4GB iPhone just three days after its debut, is now suing Apple Computer for nearly $1 million, accusing the company of "price discrimination, underselling, discrimination in rebates, deceptive actions, and other wrongdoings".

Why? Because Dongmei Li of New York lost out on the $200 price cut announced by Apple just 68 days after the July debut of its iPhone.

Obviously, there are many others like her... but not everybody is suing Apple for the inconvenience caused...

Only last month, Apple slashed prices of its 8GB iPhone from $599 to $399, inciting an angry outcry from early customers of its iconic gizmo. Simultaneously, the company phased out its 4GB iPhone model, possibly, further angering its customers.

And, the company tried its best to pacify old customers. Apple CEO, Steve Jobs, even offered a public apology on the company Web site, which said, "Even though we are making the right decision to lower the price of the iPhone, and even though the technology road is bumpy, we need to do a better job taking care of our early iPhone customers, as we aggressively go after new ones with a lower price."

Apologies apart, those who'd bought the iPhone 14 days prior to the discount, were refunded the $200 difference. And, a $100 credit was offered to early buyers at all Apple stores.

All this not withstanding, an unmoved Li, says categorically in her lawsuit, that the discount injured early purchasers such as herself, because they cannot now resell their iPhones for the same profit as later purchasers.

In the first place, market conditions did not require an Apple to go and change the price of its iPhone, says a disgruntled Li in her suit...

Every product in every market undergoes some type of mark down. In this instance, its just a matter of early buyers feeling foolish for paying so much, only to have the price dropped 3 months later. Deal with it...that's life. They don't owe it to the early customers to keep the price constant. That's retarded. Grow Up.

oh shut up, if your government didn't have to handle all lawsuits, you people will be just as "sue-happy" as you claim us Americans are. And by the way, it wasn't a tort lawsuit with 3000 different people attached. ONE American out of the thousands that bought the iPhone is suing. You are the ones sounding ridiculous trying to bash our entire country for one lawsuit. If you want to rip on us, pick a better topic than this.

Something equally good at a good price is available in India Called HTC Touch - the only small flaw is that it is powered by Windows mobile 6.0 but am a happy user for more than two months now

,Hyd, on Oct 04, 2007 12:32 PM
WM 6.0 is a flaw ? Where have you been ?? Thats a very big advantage due to the tonnes of software available for it unlike the iPhones which call them selves smart but have no room for 3rd part applications . With WM you are always feel at home

america is sue happy and there's no changing anyones mind about that. People have been sued for the most rediculous reasons. what if the phone had been out for two years and she bought it a day before a price reduction? that's not anyones fault but her own. to put it bluntly, shit happens. Deal with it. everyone else does. don't cry cause you had to be first but instead be greatful you got what you wanted and still have money to live. America is greedy and it's going to be our downfall as a nation!

In my honest opinion, there are many things wrong with this person. They were not forced to be the first in like for an iphone, therefore it was her own free will to buy it at top dollar. And through expereince, i beleive that this person understood that the value of the product was to drop soon, considering that items do drop in value over time. I know this person was not born yesterday, so there is no reason for the way they are acting toward this. Again, he/she brings up the point of "Price Discrimination". Not one person in the store was discriminated against during the time of her purchase, and since it was a month or so after she bought it, the relevance of that charge is rediculously non existant. People need to grow up and learn how to earn money, rather than sit there and try to get money from places they don't deserve. Grow up america, you lawsuit hungry country.

Not all of us are lawsuit hungry (see comment above)
Joe
,Sherman, TX, on Oct 04, 2007 02:22 AM
First of all, Mr. Justin Pinho, from Newmark, you should not make shut broad statements like,"Grow up america, you lawsuit hungry country.", because there are alot of Americans reading posts like these. Like Mark, from Texas, said, "not all Americans are sue happy." Please if you're going to post on a multi-national type of media, you should have a little net-etiquette. Anyhow, I don't agree with the lady sueing apple because she didn't pay top price for the phone but for being one of the first one to have one. This happens when you buy a car, as well. Thank you.

relax joe from texas. america deserves many generalising claims, 'sue hungry usa' is one of the most acurate. honestly mate the usa is the most out of control bunch of self serving, take no responsibility sueing countrys by far. its blows our mind in more mellow countrys where suing can only be done by/through the government. so yes very justified generalisation. and yes this person should not even get the time of day in court for the lame law suit. stop suing people because your to stupid to understand common sense america

as an early iphone buyer myself, I too feel that apple should pay for what was a clear violation of trust. I trusted that apple was providing a revolutionary product at a fair price, only to be proved wrong when my first phones screen locked up and had to be replaced. Now my second phone has intermittent lock-ups and apple decides to lower the price just two months after release because they can't sell enough of them. I was initially proud of my purchase and told everyone I knew that it was the greatest device on the planet. Now I am just embarrassed to let people know that I was one of the stupid ones who got screwed by apple. Well, screw apple... And if there is a class action lawsuit, I'm in!

Apple will chew up her little lawsuit and spit it back in her face in the form of a $2 million countersuit for trying to pull such a douche move...

She was buying the Iphone as an investment? To sell at a profit? Dumb people should not be rewarded...no they should be punished for tying up the courts.... I was a first day adopter...apple owes us nothing more than they have given us, A GREAT PHONE!

I hope Apple gets sued and loses big time. That's the only thing keeping these huge corporations in line (and halfway legal) anymore.
